Terms of Service

Acceptance of these terms

These Terms of Service (“Terms”) govern your access to and use of the 1776 AIO platform, operated by 1776 Studios, a DBA of 3:16 Roofing and Construction LLC (“1776 AIO,” “we,” “our,” or “us”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

The Service

1776 AIO is a customer relationship management (CRM) platform for home service businesses (each, a “Sender”). It provides job tracking, customer records, estimates, scheduling, photo capture, messaging (SMS, email, voice), and integrations with third-party tools that Senders may opt to connect.

Account creation and eligibility

  • Accounts are created and managed by 1776 AIO administrators, typically in coordination with the Sender’s owner or operations lead.
  • You must be at least 18 years old and legally able to enter into contracts to hold a Sender account.
  • You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately of any unauthorized access.

Acceptable use

You agree that you will not, and will not permit any user of your account to:

  • Send messages without prior express consent from each recipient, as required by the U.S. Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, and CTIA Messaging Principles and Best Practices
  • Send content related to sex, hate, alcohol, firearms, tobacco, cannabis (including CBD), loans or debt collection, gambling, high-risk financial services, affiliate marketing, political content, religious solicitation, or prescription pharmaceuticals
  • Send unsolicited marketing, spam, or any content prohibited by applicable law or by 1776 AIO’s subprocessors (notably Twilio’s Acceptable Use Policy)
  • Attempt to circumvent the platform’s consent, opt-out, or quiet-hours enforcement
  • Reverse-engineer, decompile, or attempt to extract source code from the Service except as permitted by law
  • Interfere with or disrupt the Service, its infrastructure, or other Senders’ use of it
  • Use the Service to violate any law, regulation, or third-party right

We reserve the right to suspend or terminate any account that violates these rules, and to cooperate with law enforcement or carriers in investigations of misuse.

Your data and your customers’ data

As a Sender, you retain ownership of your business data and the personal information of your customers that you store in the Service. You grant 1776 AIO a limited license to host, process, and transmit that data solely as necessary to provide the Service to you. Our handling of personal information is described in our Privacy Policy.

You represent and warrant that you have all rights necessary to upload your customers’ information to the Service and to send messages to those customers in compliance with applicable law.

Intellectual property

The Service, including its software, design, branding (“1776 AIO,” “Independent Freedom,” the 1776 AIO logo, and the 1776 Studios name), and documentation, is the property of 1776 Studios. No license is granted by these Terms other than the limited right to use the Service as intended.

Third-party services

The Service integrates with third-party platforms (including Twilio, Google Workspace, JobNimbus, CompanyCam, EagleView, RoofScope, Stripe, QuickBooks Online, Anthropic, Groq, OpenAI, Vercel, and Neon). Your use of those services is governed by their respective terms; 1776 AIO is not responsible for their availability, accuracy, or conduct. You are responsible for compliance with their policies when connecting them to your account.

Fees

Subscription pricing, billing cadence, and payment terms are set out in the order form or agreement signed with the Sender. Unpaid amounts may result in account suspension. Twilio messaging and voice costs, where passed through, are billed at cost or at the tier disclosed in the order form.

Disclaimer of warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND UNINTERRUPTED OR ERROR-FREE OPERATION. WE DO NOT WARRANT THAT MESSAGES SENT THROUGH THIRD-PARTY CARRIERS WILL BE DELIVERED OR DELIVERED ON TIME.

Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, 1776 AIO, 1776 STUDIOS, AND 3:16 ROOFING AND CONSTRUCTION LLC, AND THEIR OFFICERS, EMPLOYEES, AND AGENTS, SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY. OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO 1776 AIO IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

Indemnification

You agree to defend, indemnify, and hold harmless 1776 AIO, 1776 Studios, and 3:16 Roofing and Construction LLC from any claim, damages, liability, or expense (including reasonable attorneys’ fees) arising out of your misuse of the Service, your violation of these Terms, your violation of applicable law (including the TCPA), or your infringement of any third-party right.

Termination

We may suspend or terminate your account if you materially breach these Terms, if required by law, or if we discontinue the Service. You may terminate your account at any time by contacting us. Upon termination, your right to use the Service ends; we will retain data per the retention policy described in the Privacy Policy unless you specifically request deletion.

Governing law

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. The exclusive venue for any dispute arising out of or related to these Terms or the Service shall be the state and federal courts located in Tarrant County, Texas, and you consent to personal jurisdiction in those courts.

Changes to these Terms

We may update these Terms from time to time. The “Last updated” date at the top of this page will reflect the most recent revision. Continued use of the Service after a change constitutes acceptance.
